Child Pornography
Just because there are images of child pornography on your computer it does not necessarily mean that you are guilty of violating any State or Federal law. You need to understand that.
Traditionally most child pornography cases are handled in Federal Court.The F.B.I. has special units set up to tap into the computers of people suspected of child pornography. Lately, though, various state and county police investigators have also begun to focus on the child pornography industry.

In many child pornography investigations there is only a suspicion that an individual may be involved. Additional facts are almost always necessary to obtain a conviction. Those facts can usually only be obtained by a statement of the suspect that makes a link between them and the suspected pornography.
In most situations people share the use of computers with others in their home or workplace. If some unidentified person has been trafficking in child pornography on a shared computer the police or F.B.I. will not know which person it is without more investigation. Many times there could be no successful prosecution at all without a statement from the suspect.
The Federal or State investigation may last months. During that time phones may be tapped, computers activity tracked and emails intercepted. Still, that may not be enough. It is important that as soon as a person learns he or she is under investigation that they contact and employ an attorney.
Child pornography is a crime of specific intent. There may be a prohibited picture or image on your computer and you do not even know it. It could have come from an unsolicited email or pop up. The F.B.I may know about it and you do not. However once law enforcement swoops down on you they want a conviction. They believe the person they suspect is guilty and they will do whatever they can to put your in jail.
